DEFINITIONS

The “Seller” is defined as the legal entity Licence to Bake Ltd trading as Lulu Cakes and Bakes.

The “Buyer” means the person (legal or natural) who buys the goods.

“Goods” is defined as the items to be supplied by the Seller to the Buyer.

“Online” is defined as website www.lulupatisserie.co.uk and Mobile Application Lulu Cakes and Bakes

GENERAL

These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from the Seller you agree to be legally bound by these Terms and Conditions (“Conditions) and accept that these Conditions may be modified or amended and posted Online from time to time.

REFUNDS AND CANCELLATIONS

Booking Fees and full payments are non-refundable and non-transferable under any circumstances. This may or may not be due to loss of business arising from turning away other bookings on that date.

In the very unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible and discuss the matter with you and try to agree a suitable alternative. If you do not wish to accept our suggested alternative, then we will refund the full price to you.

If we are required to close due to government restrictions surrounding COVID-19 and are therefore unable to fulfil your order, we will work with you to try to agree a suitable alternative date for delivery. If you do not wish to accept our suggested alternative, then we will refund the full price to you.

PRODUCT INFORMATION

The images on the website are examples of our goods. All our goods are hand made and they may have variations from the website image. Any image provided as part of the description of similar goods is given for illustrative purposes only. Given the nature of the goods, variations of colour and design may apply. ALLERGIES AND SPECIAL DIETARY REQUIREMENTS

As stated on our Online shop please discuss any allergies or special dietary requirements with us before making payment. We offer various dietary options; however, our goods may not be suitable for those with certain allergies as our kitchen does handle wheat and nuts.

PAYMENT

The price will be set out Online and valid on the day of the order. Price and availability information are subject to change without notice. We accept payment by and most leading credit and debit cards including Visa, MasterCard. We are bound by Paymentsense terms and conditions for our Online payment acceptance. Payments will be charged against your card at the time of order.

DELIVERY AND COLLECTION

The goods MUST be inspected at the time of Collection or Delivery.

For Deliveries, only, in the unlikely event that your order arrives damaged, it is the customer’s responsibility to report the damage to us immediately and send photographic evidence of the damage HERE. The Seller will not take back any undamaged goods from the Buyer unless agreed in writing by the Seller. The Seller accepts no liability for goods that are damaged after they have been picked up from the shop or if delivered to the agreed location.

We cannot be held liable for any damages to the cake or goods we have delivered once we have delivered. If the goods are collected from us, we cannot be held liable for any damages to the cake or goods once they have left our premises. The collection vehicle should have a flat surface and be clean and tidy. This is the responsibility of the Buyer. The cake or goods can be very fragile so we advise to drive very slowly and carefully and purchase non-slip matting. We will always endeavour to deliver within the given time slot, however unfortunately delivery timings cannot be guaranteed. Refunds will not be given for delayed deliveries. If in the unlikely event the delivery is delayed, we will always endeavour to deliver the cake to you as close as possible to the given delivery time.

If any part of an order is found to be missing, damaged or is rejected whilst using a platform aggregation service such as Uber Eats, Deliveroo please inform their driver or their customer service team (at Uber Eats, Deliveroo) immediately who will help you with the relevant action.

AFTER DELIVERY

Goods placed outside are liable to react to the temperature. In hot or humid weather there is the possibility of sugar decorations melting or damage to Goods. Please note, we do not provide cake tables, tablecloths or cutting knives. It is the responsibility of the Buyer to provide these or check with the venue to ensure these items are provided. A shelf life and Best Before Date will be provided on the Delivery Note. This is advisory only. Please note, once cakes have been cut into the shelf life will be reduced.

NON-EDIBLE INGREDIENTS AND DECORATIONS

Our Goods may contain non-edible ingredients or decorations, such as plastic dowels in tiered cakes or wires in some sugar flowers. These will be detailed on the Delivery Note and must be removed before serving or eating.

COMPLAINTS

If you wish to make a complaint to us or let us know any concerns after receiving the Goods, please do so HERE. Evidence of any faults, damages or discrepancies should be included. Any refunds will be given entirely at our discretion.

LIABILITY

The liability of the seller in contract, tort (including, without limitation, negligence) or otherwise in respect of any goods delivered or otherwise in connections with an order or for any loss, injury or damage attributable directly or indirectly thereto will, at the sole option of the Seller, be limited to: (a) delivering replacement goods (at Seller’s expense); or (b) refunding any sums paid to the Seller for the goods.The Seller will not be liable (whether or not caused by Seller’s negligence) for any loss of profit or goodwill or opportunity or reputation suffered or incurred by any third party, nor for any indirect or consequential loss.

Nothing in these terms will limit or exclude the liability of the Seller for death or personal injury caused by negligence on its part and nothing in these terms will affect your statutory rights.

ONLINE SERVICES PROTECTION

All right for the text, graphics, design of the site, computer codes and all other content or interfaces from the Online services belong to the Seller and the Seller’s 3rd parties Software providers. Any other use (including without limitation any further reproduction, storage or transmission to anyone) of any Online materials without our prior written permission is strictly prohibited.

AMENDMENTS AND VARIATIONS

The Seller reserves the right to amend the terms of this Agreement from time to time. Your continued use of any part of the Online Services after any such amendment will constitute your acceptance of the amendment or amendments concerned. You should therefore regularly visit these terms and conditions to ensure that you keep up to date with your rights and obligations under this Agreement. If any such amendments are considered in the reasonable opinion of the Seller to be material, notice of the amendments will be emailed to all registered users of the Online Services at their registered email address.If you do not wish to accept any amendments, you should withdraw your registration from the Seller Online Services.

JURISDICTIONS

This Agreement is governed by English law and both the Seller and the Buyer agree to submit to the exclusive jurisdiction of the English courts.

ACCESS/ FORCE MAJEURE

In the event, the Seller cannot fulfill obligation to the Buyer under this agreement due to any event beyond our reasonable control, we will do our best to notify you and as such we will be relieved of our obligations to you under these terms and conditions to the extent that our service is hindered by such an event.
